1. Introduction and Acceptance of Terms
These Terms form a legally binding agreement between you and Maple Crest Furnishings Ltd. relating to the sale, design, delivery, installation, assembly, upholstery, and related consultation services we provide in Canada. By using our services, you confirm that:
- you have read and understand these Terms;
- you are at least the age of majority in your province or territory, or you have the consent of a parent or legal guardian;
- you have authority to enter into this agreement if acting on behalf of a business or organization; and
- you agree to comply with all applicable laws and these Terms.
We may require additional written agreements, quotes, purchase orders, or service schedules for certain projects. If there is a conflict between these Terms and a signed written agreement, the signed written agreement will prevail to the extent of the conflict.
2. Scope of Services
Maple Crest Furnishings Ltd. provides furniture-related products and services, including but not limited to:
- custom furniture design;
- residential furniture sales;
- office furniture solutions;
- furniture delivery and setup;
- space planning and layout consultation;
- furniture assembly; and
- bespoke upholstery options.
Any images, renderings, measurements, samples, specifications, or descriptions we provide are for illustrative purposes unless expressly stated otherwise in writing. Minor variations in color, grain, finish, fabric, stitching, dimensions, materials, or configuration may occur due to the nature of furniture manufacturing and natural materials.
All custom and made-to-order products are produced based on the specifications approved by the customer. You are responsible for reviewing all final measurements, design selections, fabric choices, finishes, and layout details before approval.
3. User Obligations and Responsibilities
You agree to provide accurate, current, and complete information when requesting services, placing an order, or booking delivery or installation. You are responsible for:
- ensuring measurements, room dimensions, access paths, elevator availability, stair clearance, and placement areas are accurate and suitable for delivery and installation;
- confirming that premises are safe and accessible for our personnel and contractors;
- obtaining any required building approvals, condominium permissions, parking permits, or landlord consents;
- protecting existing floors, walls, fixtures, and property where needed, unless we expressly agree otherwise in writing;
- removing items that may obstruct delivery, assembly, or installation;
- reviewing all product and service details before authorizing production or delivery; and
- paying all amounts due in accordance with the applicable invoice, quotation, or agreement.
You must not misuse our website, staff, products, or services, including by providing false information, interfering with operations, attempting unauthorized access to systems, or using our services for unlawful purposes.
4. Payment Terms and Conditions
Unless otherwise stated in a written quote or agreement, all prices are in Canadian dollars (CAD) and are subject to applicable taxes, delivery fees, installation fees, assembly fees, restocking fees, administrative charges, and other costs disclosed before purchase or as otherwise permitted by law.
Payment terms may vary depending on the order type and may include:
- full payment in advance for retail purchases or smaller orders;
- a deposit for custom, bespoke, or made-to-order items;
- progress payments for larger residential or commercial projects; and
- final payment before delivery, at delivery, or upon completion, as specified in the invoice or agreement.
If a deposit is required, production, procurement, or scheduling may not begin until the deposit is received and cleared. Orders are not confirmed until payment terms are satisfied or otherwise approved by us in writing.
If payment is late or declined, we may suspend services, delay delivery, charge reasonable collection costs, and apply interest on overdue amounts at the maximum lawful rate or, if no rate is specified, at 1.5% per month (18% per annum), calculated from the due date until paid in full, to the extent permitted by law.
We reserve the right to correct pricing errors, typographical errors, and omissions. If a material pricing error affects your order, we may cancel the order and refund any amount paid, or we may seek your written confirmation of the corrected price before proceeding.
5. Cancellation and Refund Policy
Because many furniture products are custom-made, made-to-order, or specially sourced, cancellations and refunds may be limited. The following applies unless a stricter or more specific written policy is provided for a particular product or service:
- Standard retail items: Subject to inspection and eligibility criteria, returns or exchanges may be accepted within a reasonable period if unused, in original packaging, and accompanied by proof of purchase, less any applicable restocking or return shipping fees.
- Custom, bespoke, altered, upholstered, or made-to-order items: These are generally non-cancellable and non-refundable once production, procurement, fabrication, or customization has begun, except where required by applicable law or where we agree otherwise in writing.
- Design, consultation, and planning services: Fees for completed consultations, measurements, renderings, space planning, and similar professional services are non-refundable once performed.
- Delivery, assembly, and installation: These charges are non-refundable once the service has been scheduled or performed, except where we are legally required to provide a refund or re-performance.
If you request cancellation before production or ordering from a supplier begins, any refund, if available, may be reduced by non-recoverable costs, administrative fees, design fees, and supplier charges already incurred by us. Deposits for custom work may be non-refundable to the extent permitted by law and disclosed in the quote or agreement.
To initiate a cancellation or refund request, contact us in writing at the email address listed below. We may require photographs, order details, and other documentation to assess the request. Any refund approved by us will be issued using the original payment method where practicable, subject to processing timelines of financial institutions.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Crest Furnishings Ltd., including its directors, officers, employees, contractors, and agents, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, data, goodwill, or anticipated savings, arising out of or related to the use of our services, products, or website, even if we have been advised of the possibility of such damages.
Without limiting the generality of the foregoing, we are not responsible for:
- damage caused by inaccurate measurements, incomplete site information, or failure to follow care instructions;
- damage arising from unsafe, inaccessible, or unsuitable premises;
- normal wear and tear, fading, shrinkage, settling, or material variation;
- damage caused by misuse, neglect, improper cleaning, unauthorized modification, or third-party handling;
- delays caused by suppliers, carriers, customs, weather, labour disruptions, or events beyond our control; or
- installation issues resulting from conditions hidden at the site, including wall defects, uneven floors, inadequate anchoring surfaces, or pre-existing damage.
To the extent permitted by law, our total liability for any claim arising out of or related to the products or services provided shall not exceed the amount paid by you to us for the specific product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or fraud where such exclusions are prohibited.

9. Force Majeure
We will not be liable for any delay or failure to perform our obligations where such delay or failure results from an event beyond our reasonable control, including but not limited to acts of God, fire, flood, extreme weather, power outages, labour disputes, pandemics, epidemics, war, civil unrest, transportation disruptions, supply shortages, government action, customs delays, or third-party service failures.
If a force majeure event occurs, our obligations will be suspended for the duration of the event, and we will make reasonable efforts to resume performance as soon as practicable. We may also adjust schedules, substitute materials where reasonable, or cancel affected orders if continued performance is not commercially feasible or legally possible.
10. Changes to Terms
